This Privacy Policy sets out how Whizzy Logistic Technologies Private Limited (henceforth “Whizzy” “Our” “Us” “We”) uses and protects Your information shared with Whizzy while using Whizzy’s Mobile Application (“Platform”), where Whizzy provides food delivery and other pick/drop services to You (“Services”). This Privacy Policy shall apply to the Users, Delivery Personnel, and Merchants. For the purpose of this Privacy Policy, the Delivery Personnel, and the Merchants shall together hereinafter be referred to as "You", "Your" or "Yourself".  By accessing or using any part of our Services on the Site, You agree to be bound by the Terms and Conditions and Privacy Policy (collectively, the “Policies”). The Policies are hereby incorporated into these Terms by reference as if set forth herein.

We want to ensure that You understand how Your data will be processed by Us and assure You that You are in complete control of Your data. By reading this Privacy Policy You will understand what data of Yours We collect, why We collect such data and how the data is used and managed on Our Platform. We want to inform You that We are committed to protect Your Privacy on Our Platform.

Please read Our Terms of Use which further describes the way We function, the services that We provide to You and under what terms You can use Our Platform. 

DEFINITIONS

  1. “User” “Customer”, means any natural person who has agreed to become a member/user of the Platform by providing account information detailed under the Privacy Policy while registering on the Platform as a Registered User.
  2. “Merchant” means the hotel/restaurant/food vendors/eateries that provide their items/products on Our Platform for purchase to the Customers. 
  3. “Delivery Personnel” means the delivery persons provided by Whizzy for the purpose of pick-up drop of the items and products purchased by the Customers.

NATURE AND CATEGORIES OF INFORMATION THAT WE COLLECT WHEN YOU USE OUR PLATFORM:

  • Account Information: When You create Your account on Our Platform, We collect the information provided by You such as Your name, email address, Address and contact information or any other optional information that You voluntarily provide.
  • Device Location: We collect Your device geographical location through GPS, WiFi or Bluetooth.
  • Demographic Information: When You create Your account and use Our Platform, We collect information such as postal code, Your preferences and interests and other additional information that is relevant for the purpose of providing Our Services.
  • Network information: When You access or use Our Platform We collect network-specific information such as, mobile network, connection information including whether You are using WiFi or cellular data.

In addition to the above, in case You are a Delivery Personnel or Merchant, we shall collect the additional information from You such as location details, copies of government issued identification documents, statutory registrations, KYC details, call and SMS details. Additionally, if You are a Delivery Personnel, We may also collect certain health related declarations (including body temperature, symptoms such as fever, cough, cold, vaccination status information and other health conditions). We may also ask You to provide any other personal information which You give us in connection while availing booking a service or is relevant to customer surveys and/or offers available on the Platform. 

WHY DO WE COLLECT THE ABOVE INFORMATION FROM YOU:

We require the above information from You to understand Your needs and to provide You with a better service on Our Platform.

  • We collect Your account information to enable You to use Our Platform, without providing Your account information, You will not be able to login-in or access Our Platform and avail Our services. 
  • We collect Your device and demographic information to enable You to locate Your precise location in order to show You restaurants and other stores nearby to You. When You download Our mobile application, We use this information to provide You with notifications related to various offers and services on Our Platform.
  • We collect Your network-specific information to connect Your account with Our servers in order to provide You with  a better experience on Our Platform.

WHOM DO WE SHARE YOUR INFORMATION WITH:

For the purpose of providing Our Services, we share Your information as follows:

  • With Whizzy Delivery Personnel: We share Your phone number and Address with Our Delivery Personnel in order for the Delivery Personnel to reach out to You for the delivery of Your desired product 
  • With Partner Restaurants/Merchant: While You place a request to order food through the Our Platform, Your information will be shared with restaurants/merchants with whom You may choose to order. In order to facilitate Your online food order processing, we provide Your information to that restaurant/merchant in a similar manner as if You had made a food order directly with the restaurant.
  • For compliance with Law: We may share Your information with governmental agencies or other companies assisting Us, when We are:
  1. Obligated under the applicable laws or in good faith to respond to court orders and processes; or
  2. Detecting and preventing against actual or potential occurrence of identity theft, fraud, abuse of Services and other illegal acts;
  3. Responding to claims that an advertisement, posting or other content violates the intellectual property rights of a third party;
  4. Under a duty to disclose or share Your personal data in order to enforce our Terms of Use and other agreements, policies or to protect the rights, property, or safety of the Company, our customers, or others, or in the event of a claim or dispute relating to Your use of our Services. This includes exchanging information with other companies and organisations for the purposes of fraud detection and credit risk reduction.

HOW DO WE STORE AND RETAIN YOUR DATA:

We store Your data on a dedicated Cloud with high-end security systems and store it as long as You wish to avail Our services. The moment You delete Your account, the information collected by Us will be deleted instantly.

WHAT PRIVACY CONTROLS DO YOU HAVE:

We want You to understand that You are the master of Your data and that You have complete control over it. To assure You of the same, We provide You with tools and mechanisms in order to manage Your data on Our Platform:

  • Review Your Data: We understand that You may want to review the data provided by You from time to time. To do the same, You may visit Your profile, where all the information provided by You will be displayed.
  • Edit/Amend Your Data: We provide You with tools that enable You to amend the information provided by You. For example, if You wish to change Your phone number or email address provided by You during registration, the same can be edited/amended by availing Our edit option.
  • Delete Your Data: When You no longer wish to use Our Services, You can discontinue by deleting Your account from Our application.

HOW DO WE OPERATE AND TRAFER YOUR INFORMATION:

We do not share Your data internally or with third party partners/vendors outside India. Any change in Our data transfer sharing practices in the future will be intimated to You and You may review Our revised policy and consent to Our revised data transfer practices.

HOW DO WE PROTECT AND SAFEGUARD YOUR INFORMATION:

  • The information collected from You is saved and stored on servers which are password protected to ensure there is no unauthorised access to it. We strictly adhere to security guidelines to ensure to protect Your data that is in Our possession.
  • We store Your information over secure cloud service providers who offer security standards competitive with the industry norms. We also protect Our servers with using SSL, and information access authorization controls. We take all the reasonable measures to preserve the integrity and security of the Platform and Your information that is in Our possession.
  • We have adopted all reasonable safeguards as mandated by the applicable law in order to protect Your information. The information provided by You is stored only in the servers of India.
  • Despite Our best practices of safeguarding Your information, You understand and accept that there is no guarantee that data transmission over the Internet will be completely secure and that any information that You transmit to Us is at Your own risk. We assume no liability for any disclosure of information due to errors in transmission issues, unauthorized third-party access to Our Platform and data bases or other acts of third parties or acts or omissions beyond Our reasonable control and You shall not be entitled to hold the Company responsible for any breach of security except in case of wilful negligence on the part of the Company.

Our website may contain links to other websites of interest. However, once You have used these links to leave Our site, You should note that We do not have any control over that other website. Therefore, We cannot be responsible for the protection and privacy of any information which You provide whilst visiting such sites and such sites are not governed by this privacy policy.

CHANGES TO PRIVACY POLICY

We process Your information based on the consent You expressly grant to Us at the time We collect such data. In case We change Our Privacy Policy which further changes the way We process and manage Your data, We will notify and give You an opportunity to review the revised Policy before You choose to proceed with Our services.
